A Sydney man has managed to avoid a $350 fine after proving he was not using his phone while driving, but instead opening a packet of cheese and crackers.
The 35-year-old was captured by a mobile detection camera in Moore Park, apparently driving with something in his hands.

He was accused of using a phone behind the wheel, and was issued with the $350 fine, which also cost him five demerit points.
However the driver was able to get the fine overturned after arguing that he was actually opening up a packet of the ALDI-branded Dippits.
In court, the man demonstrated exactly how to open a packet of the cheese and cracker snack.
As reported by the Daily Telegraph, the man’s lawyer Benjamin Goh argued his client was a “hardworking Australian” who was “simply trying to have his afternoon tea after finishing work”.
“My client had proper control of the vehicle because the photo showed his left hand was in contact with the steering wheel while he was attempting to open the packet,” Goh said.
Mobile phone detection cameras have been operating in Sydney since March 1, 2020.
