A mum was crying and gurgling as she begged her drug addled son to stop his shocking assault which included pressing his thumbs into her throat.
An argument erupted into violence on May 23, 2022 at a Sarina Beach home when Anthony Troy Deller pushed a table towards his mother’s face.
Mackay District Court heard he then put his hands on her neck and pushed his thumbs into her throat.
“She couldn’t speak, she made some gurgling noises,” Judge Michael Burnett said.
“She thought she was going to die.”
The court heard he demanded keys and punched a wall near her head before throwing her to the ground.
She cried and was “begging you to stop”, Judge Burnett said as he sentenced Deller on Friday.
The 32 year old, who has a three page criminal history, pleaded guilty to unlawful choking and two counts of common assault, all of which have maximum penalties of seven years jail.
Crown prosecutor Matthew Sutton said the offending also involved “acts of degradation” including name calling.
Barrister Scott McLennan said his client was “extremely ashamed of his behaviour” upon which he had three months to reflect while in custody on remand.
Mr McLennan said there was a link between his client’s offending and methylamphetamine use.
The court heard Deller had been using ice when he assaulted his mother.
Mr McLennan pushed for 2.5 years jail with immediate parole release “so he can continue with his rehabilitation”.
“Rather than set it back by sending him to jail,” he said.
The court heard Deller had been exposed to extreme violence growing up and Judge Burnett labelled it a sad case of “monkey see, monkey do”, labelling this a “very concerning aspect of the case”.
Deller was jailed for 2.5 years with immediate parole. Convictions were recorded.
